According to a story filled at InformationWeek.com an individual living in San Diego has filed suit against both Bungie and Microsoft with the claim that Halo 3 went to retail with a defect or defect that, according to the filer of the suit, causes the Xbox 360 to “crash, freeze, or lock up” during gameplay.. This allegation stems from the the purchaser of the flawed copy of Halo 3, one Randy Nunez, who asserted that his copy of Halo 3 would continually crash during gameplay. Nunez has stated that this is a widespread problem with Halo 3 that neither Bungie or Microsoft have taken steps to rectify.

In strict legal terms both Bungie and Microsoft are being accused of violating consumer protection laws and, to continue the legal terminology, Nunez wants to have his case accorded class action status so that other Halo 3 owners who have experienced similar difficulties can add their voice to that of Nunez’s. At the time the story was filled with InformationWeek neither Microsoft nor Bungie had responded to this legal attack on the latest release of their flagship title.
